Memorie.al/ publishes some archival documents extracted from the Central State Archive in Tirana (fund of the former Central Committee of the ALP), which are detached from a voluminous file with the initials “Top secret” which belongs to the 1980s- 1982 and talks about the sensational event of the tire rupture of some of the vehicles of the foreign diplomatic corps accredited in Tirana, which disturbed even the main leader of the Party, Enver Hoxha, who immediately called the Minister of Internal Affairs, Feçor Shehu , where, at the height of his anger, the “Commander” said: “If for 24 hours you do not find out who and why damaged the vehicles of foreign embassies in Tirana, find a hole and enter”! The alarm of the Minister of Interior, Feçor Shehu, who called for an urgent meeting, all the main directors of the department he headed, and after making clear to the “Commander” the great concern, lest that event would create a diplomatic incident with several countries, Within 24 hours, the State Security organs and other structures of the Ministry of Internal Affairs managed to discover the perpetrator of the “crime”, Prendushme Deda, an employee of the Municipal Enterprise of the capital, who was working on cleaning the streets, which was caught in flagrante delicto in front of the “Dajti” Hotel while packing the tires of some of the vehicles of the diplomatic corps in Tirana. Rare testimony of the former Director of the Central Forensic Laboratory of the Ministry of Internal Affairs, Neshat Tozaj, given shortly before he passed away, regarding the heated debates and his clash with Minister Feçor Shehu, after he, as the head of the laboratory he led, refused to sign the expert report, to consider the cutting tool as a “cold weapon”, with which the cleaning worker had broken the tires of some of the vehicles with “CD” license plates! Feçor Shehu’s threat to his subordinate who immediately fired him, sending him as a screenwriter to the Kinostudio “Shqipëria e Re” and Tozaj’s long odyssey, to restore his honor and dignity, sending him letters complaints of the Prime Minister Mehmet Shehu and then Enver Hoxha, which became the cause of the cooling and the first clash between the two highest leaders of communist Albania, of that time! Enver’s accusations against Mehmet Shehu, that: why he had kept secret the sensational event that shook official Tirana (for fear of a diplomatic incident with several countries), where after his death and the arrest of Kadri Hazbi and Feçor Shehu , that event resurfaced “on stage” and as a result, all members of the “hostile group” who had been accused of damaging the vehicles of foreign embassies (with the exception of Prendushe Deda, who was released under amnesty) were released from prison and internment. of 1986), and the return to work of Neshat Tozaj (as Director of the Central Forensic Laboratory at the Ministry of Internal Affairs) who a few years later, wrote the novel “Knives”, which would then make a fuss great, being republished several times!

The secret document with the report drafted by Rexhep Kolli, a senior official in the apparatus of the Central Committee of the ALP for the bodies of the Ministry of Internal Affairs, sent to his superiors, regarding the problem of the “hostile criminal group”, who were arrested and convicted of damaging vehicles of foreign embassies in Tirana!
SOME PROBLEMS TO BE IMPORTED TO THE PARTY COMMITTEE OF THE MINISTRY OF INTERNAL AFFAIRS
Second: will increase the care for the recognition, implementation and protection of the Party line, expressed in the Operational Work Platform, in laws and other normative acts.
We say this because it is clear from the actions taken that; some cadres did not have the right concept for directives, laws and normative acts. How can you say: “I started with good intentions and broke the laws”?! What about the legal norm or that of the Platform do not have a good intention? No friends, these judgments are not partisan, they smell of anarchism.
Comrade Elham and some others started from the concept “to arrest, because we are convinced that during the process we will dismantle it, we will prove the hostile activity”. Why comrades, so the law says, that the investigator is obeying can arrest a person? The law requires that evidence be administered and only on the basis of their analysis be formed the conviction whether or not to be arrested. In the bourgeois system the concept operates: “the end justifies the action”, but not in our socialist system.
How can we say there is a clear concept of norms, when the opinion of the Central Laboratory was ignored under the pretext that Neshat Tozaj, “is not objective, does not judge the situation.” What about changing the investigator’s decision, to erase the traces of the expertise acts that said knives are not cold steel, is it a judgment with objectivity? The regulation of the Central Laboratory was not well known by these comrades and they thought that it has no power for the investigator, but the order of the Minister No. 01-4 dated 29.2.1980 “On the manner of implementation of the new provisions of the Code of Criminal Procedure of RPSSH”, why he was not known by these friends and why he had no power over them ?!
Laws and normative acts were not implemented because they violated the main cadres themselves, starting with the director of Investigation. Why did not the branch dealing with the control of legality act? How should she act, when its chairman, Comrade Reshat Leskaj, said in the first meeting of the basic organization: “I am of the opinion not to go deeper into the masses, to close it with that” ?! To operate this branch, meant to bring to justice the comrades: Elham Gjika, Faraudin Poçari and Sokol Kolekën. Comrade Reshat Leskaj did not do this without the order of the director, especially when the case was against the director. So sick familiarity to the detriment of legality.
Comrade Enver at the 8th Congress of the Party, among other things, emphasized: high of them are necessary conditions to increase the activity of these bodies, to further strengthen the class spirit, partisanship and objectivity in the exercise of functions”. This lesson of Comrade Enver will be deeply absorbed by every communist and cadre.
Third: From what we have seen, it turns out that the working method in the ministry apparatus has flaws and bureaucratic manifestations. Therefore, the Party committee and grassroots organizations should increase their care in this regard. Here, too, Comrade Feçor must increase demand.
It is not at all a revolutionary working method, what happened such a serious violation and no analysis was done in the directorate. It is not a revolutionary working method, what the generalization for this violation was done by the one who was responsible and moreover without analyzing the problem, even worse even when he makes the generalization, they did not work at all with the directorate staff. The Party Committee must draw conclusions from what the organization said, that Comrade Elham as director did not take the opinion of the management officers and branch presidents on plans, personnel and investigative matters, that he had displays of arrogance and arrogance towards cadres etc.
Comrade Feçor, we are of the opinion that he should not have allowed his secretary to perform an expert act outside the Central Laboratory. On the other hand, Comrade Feçor acted correctly, giving the order to be analyzed, to draw conclusions and to report to him, but it would be fairer to say to Comrade Elham, that with three or four comrades who had not invested in the matter, prepare the analysis, give it to him and put himself in this analysis or send one of the Deputy Ministers. In addition, he would do well to ask his friends how his orders were implemented, because as it turned out they were not implemented and the analysis was not done and conclusions were not drawn.
Fourth: The event highlighted the fact that there are many foreign performances and concepts, such as the spirit of familiarity, arrogance, self-interest, disregard for the opinion of friends, stifling criticism, etc. Do not look at these as something that happened only to Comrade Elham, to the communists and the cadres of the Directorate of Investigation, as something that happened by chance, but as the 8th Party Congress instructed, to be seen as aspects of the class struggle in the bay. Ours, as the pressure of bourgeois and micro-bourgeois ideology on us and that are enlivened by our insufficient political-ideological work.
Therefore, taking the occasion from this event and from what this basic organization produced, to reflect deeply to fight better and more forcefully these performances. Bear in mind what Comrade Enver emphasized at the 8th Congress of Paris, that: the class struggle that is taking place in our country… ”And further:“ to develop the class struggle correctly, means to apply correctly the Marxist-Leninist line of the Party, to accept with deep knowledge and conviction the principles of socialism, to work always for the good of the people and the homeland, to preserve and protect socialism ”.
Fifth: To pay more attention to the correct conception of the relations of the Investigative bodies with the bodies of the Prosecution and the Court. They are organs of the Party as well as organs of Internal Affairs. Therefore, it is not right for you to conceal the truth from them. When they reveal our transgressions, let us not respond to them shallowly, irresponsibly, but give them full explanations, clear and accountable. It is also not right for us to intervene inappropriately, time and time again to lightly or severely punish this or that person. The task of the Investigator is to conduct an objective investigation and send everything to the ground court.
We raise this as comrades in the grassroots organization set examples of wrongdoing in this regard.
Sixth: We think it will take more care regarding innocence. The whole job is for investigators to start and conduct investigations with objectivity, partisan spirit and always based on laws and careful administration of evidence. When investigators do so, they do not need to be alarmed if the Court of First Instance or the Court of Appeal acquits them.
The innocence that can be given by the judicial bodies does not create that feeling of fear in the investigators, because it can lead some investigators to two serious mistakes: either to suspend and dismiss these cases, or to manipulate the evidence to ‘unfairly brought to trial. Look at this carefully without being influenced by our opinion, but know that fellow court members have this concern for the investigation.
Perhaps in this case, one of the reasons that was not later reflected to correct the mistakes made at the beginning of the criminal case, is that “the sieves turn out to be innocent, we kept these three months in prison”?

FOR THE CLARIFICATION OF THE ISSUE RAISED BY THE MEMBER OF THE PARTY NESHAT TOZAJ IN THE LETTER ADDRESSED TO COMRADE ENVER HOXHA
From the verifications made it appears that; the issues raised by the party member Neshat Tozaj, in the letter addressed to Comrade Enver Hoxha, are completely right.
- On October 26, 1980, Prendushe Deda was caught red-handed, breaking the tires of foreign diplomats’ cars. From her allegations, 5 other persons were implicated, 3 of whom were women. Everyone was rightly banned.
During the three days of detention, the Investigator forcibly provided evidence to obtain the sanction of arrest for 4 persons. The problem remained with Lindita Beka, a girl born in 1959 and a worker at the “Dinamo” factory, for whom only the fact that she gave the knife to Prendushe Deda was proven, but without knowing what her purpose was. The Central Forensic Laboratory, from two experiments conducted, concluded that knives were not cold steel. Therefore, the Tirana Investigator released Lindita Beka on October 29, 1980.
In these conditions, by order of the Director of Investigation, the acts of the Central Forensic Laboratory were removed from the file and called as experts, the Secretary of the Minister, Comrade Farudin Poçari, together with an expert of the Directorate of Internal Affairs Tirana, who described them as “cold weapons” and with this illegal act the sanction of arrest was lifted.
- On January 23, 1981, after three months of investigation, it was proved that we were not dealing with a diversionist group. For this reason, the Directorate of Investigation concluded that the 6 defendants arrested as a group should be brought to trial divided into three cases: The first case with three defendants, of whom only one for a crime against the state and two others for not reporting a crime, the second case with two defendants, one of whom for misappropriation of socialist property with a value of 284.40 ALL, for holding knives as illegal cold steel and the other, only for carrying weapons unauthorized cold, the third case with a defendant for provocation, illegal birth failure.
In the face of this situation, the comrades of the Investigation had to stop and reflect on this process that started with so much fuss and that led to the violation of the rights of some citizens, because a girl was arrested and sentenced to 4 months imprisonment with evidence of manipulated, three families were unjustly interned, and there was room for two persons to be subjected to criminal policy.
- The General Prosecutor’s Office and the High Court, in April 1981, made the relevant interventions and informed Comrade Feçor Shehu about the violations found. Nevertheless, I still did not stop to delve deeper into the violations of the law, the causes and the responsibility. It all ended with a shallow criticism at the collegium meeting, the basic Investigative organization and the Ministry’s Party Committee. On May 12, 1981, a formal generalization was made and sent to the district branches.
- When on December 7, 1981, we started asking for explanations regarding the violations and their consequences in this criminal process, the comrades of the First Directorate, the Directorate of Investigation, and those of the Directorate of Internal Affairs of Tirana, not only did not openly told her about the flaws, mistakes, and violations committed, but tried to hide them, collecting materials in the wrong way, to prove that “the measures taken against Lindita Beka and her family were right ”. Only after we made some confrontations with the cadres, after carefully studying every document and action performed, were we able to unravel the truth. We submitted the conclusions on the verification to the relevant basic organization of the Directorate of Investigation and then to the Party Committee of the Ministry./Memorie.al
The next issue follows
