– THE FORECAST MURDER OF A CLERGYMAN OF THE RENAISSANCE –
Memorie.al / Before we begin to briefly analyze the investigative and judicial file in charge of the defendant Shtjefën Kurti and others, for the reader we will make a parenthesis of the right and its history in human society, with the goal of coming to our criminal and procedural law, from its beginnings and throughout the years of the dictatorship.

The above form, as seen from the figures, has given the desired results in terms of the amount of stolen goods and the activation of many people in this ugly act. But this is the only form. The above-mentioned defendants, in order to achieve economic sabotage in the Fushë-Milot cooperative as soon as possible, talk to each other about how and in what form to burn the cattle stables and millers, in what way and in how to throw poison in the bakery, how to organize preventing people from going to work and others. If some of these have remained at the conversation stage, for some it has been worked to implement the practice in the broad measure of cooperatives, talking in their environment and intimate circle about the futility of their going out in agricultural work, they have done damage during works, such as damaging plants, preventing tractors from working, etc.
Another form of sabotaging the cooperative economy used by the defendants was that of compromising the management of the agricultural cooperative, not only by compromising them to leave a better path for embezzlement in the agricultural cooperative, but on the other hand, by compromised, they would rot and would not give all their opportunities and abilities to the success of the cooperative and moving things forward. By acting in this way, it would bring about the results desired by these enemy elements, decrease the income and lead to the destruction of the agricultural cooperative. This is how the defendant Mark Marku acted to compromise brigadier Fran Voli, who ordered him to buy cement in Milot, while the defendant Mark takes stolen cement from what he was transporting for the agricultural cooperative. And this defendant, when he finds that there was an extra quintal of hemp in the warehouse, he resells it and for the money he makes, he gives a reward to the head warehouseman Pjeter Mirash. Or the defendant Zef Nishi, who offers for sale to Brigadier Fran Vol, a quintal of wheat stolen from the mill and others.
The defendants Mark (Bardhok) Marku, Pjetër Biba, Zef Nishi, Fran Ndoci, eventually became aware of the activity of theft, closely related to their hostile activity and the goal that through increasing thefts to weaken the economy and achieve the destruction of agricultural cooperative, in order to implement this plan, they extend this activity not only to the circle of the defendants who are in this case, but also to many other people, thus creating groups and sub-groups and acting intensively. It is enough to mention that the defendant Mark (Bardhok) Marku acted for the embezzlements with eight groups. Similarly, the other defendant Pjeter Biba acted with such groups, the defendant Zef Nishi with three groups, while the defendant Fran Ndoci, with two groups. These groups extended their activity within the bosom of the implicated defendants as well as many other persons, some of whom have been questioned as witnesses.
The defendants Mark Marku, Pjetër Biba, Zef Nishi, and Fran Ndoci, implementing the decision made in collaboration with the other defendants, Shtjefën Kurti and Agustin Preçi, to continue the thefts with the aim of achieving the destruction of the cooperative, in cooperation with each other and with a number of other free persons, some of whom have been questioned as witnesses, have intensified thefts to the detriment of the economy of the agricultural cooperative, using various forms, causing the cooperative damage of 45,128 ALL, from which the defendants in particular have derived the following benefits: 1) Mark Marku 12,239 ALL, 2) Pjeter Biba 3,931 ALL, 3) Zef Nishi 3,080 ALL, 4) Fran Ndoci 1,919 ALL and 5) Ndue Leti 3,573 Lek. All the above appropriations were made with a counter-revolutionary goal to reduce the income, the members of the cooperative would get as little as possible, become dissatisfied, rise up against the cooperative and in this way achieve its destruction.
From all this hostile and sabotaging activity carried out by these defendants, the agricultural cooperative of Fush-Milot, until the end of 1969, has managed to be one of the most backward cooperatives, either for participation in work, for yield, total production and for the low value of the working day. All these had brought dissatisfaction among the members of the cooperative, which caused non-participation in work. While after hitting these furious elements of the government with the measures taken by the Party and the government, it resulted that the Gurezi sector of the agricultural cooperative “Ndoc Deda” of Fush-Milot, for the year 1970, came out with better results than the other three sectors of to this cooperative, increasing the total production in the various crops, with the increase in the value of the working day, almost double what they were getting before. All this strengthened the confidence among the members for the joint work in the cooperative, which is proven by a full participation in the daily work of the agricultural cooperative.
Regarding this activity, the defendant Shtjefën Kurti spoke to the investigator:
“… At the dinner that we supposedly organized for fun at my house, which was attended by: me, Pjetër Biba, Mark (Bardhok) Marku, Zef Nishi, Prena and Dava Biba, in addition to the hostile conversations we had, which I have talked about in the previous processes, we held conversations about the thefts in the Gurezi cooperative and about escaping abroad. I, in this case, told Peter, Mark and Zefi that, for the thefts you do, you get your toil and sweat. Everyone agreed on the continuation of the thefts. Biles I told them that we should organize other people to continue the thefts, in order to lower the prestige of the cooperative, which would be against the government. Everyone agreed with my opinion that the thefts should continue, in order that the people would get as little income as possible and in this way, to arouse resentment in the people against the cooperative and to rise up to destroy it…” and the following continues : “… In the spring of 1969, in a conversation with Pjeter Biba and Zef Nishin in my room, talking with them about life in the cooperative and we presented it as difficult, the conversation came up about the thefts that were done in the cooperatives and I told them that they stole that by stealing the income would decrease, the people would become unhappy, and they would rise up for the destruction of the cooperative…”!
Defendant Mark (Bardhok) Marku, regarding the issue of sabotage, explains to the investigator: “… At this dinner, both by Shtjefën Kurti and by the rest of us, by me, Pjetri and Zef Nishi, many other conversations against the party took place and power…! The four of us set ourselves the task of gathering around us as many unhappy people as possible, to damage the economy of the agricultural cooperative as much as possible through theft, to carry out the thefts in the most extensive style, filling their minds. and other people to steal as much as possible and prevent people from going to work in the cooperative. By acting in this way, we would achieve that the cooperative would become impoverished, its members would not share anything from the products. This would arouse resentment and hatred in the people and eventually the cooperative would be destroyed.
These conversations about the destruction of the cooperative at this dinner were made by all of us…! As a result of the conversations and the decision to destroy the cooperative, I, together with Pjetër Biba, Zef Nish, Fran Ndoci and Agustin Preçi, said that we should not perform the daily tasks in the cooperative well, we should try not to ensure the agricultural production , so that it would go to waste, starting from the wheat and corn and down to their straw, so that these products would be wasted and go to waste, as well as for the food base of the fat and small cattle…”!
While the defendant Agustin Preçi, speaking to the investigator about the issue of sabotage, said, among other things:
“… Fran Ndoci and I were engaged in hostile activities against the government, they hated the government and the political economic system of our country, they constantly spoke badly about the government, about the change in the situation in Albania, about the change of today’s economic system to a private economic system, for breaking up the agricultural cooperative and taking back the lands from our side. We talked to each other so that the production of the cooperative would be reduced in order that the income of the members would be low, the members of the cooperative would become dissatisfied and in this way they would rise up for the destruction of the cooperative.
So Frani and I talked about burning the stables of the cooperative in order to cause great damage to it, we also talked about burning the easels. When we worked on the sale of corn, me, Frani and Marku, with the aim of damage, instead of thinning the weak plants, we thinned the healthy plants. We have caused such damage during harvesting, threshing of wheat, sunflower, etc. Last year it was summer time, as Frani and I were near the bakery of our cooperative, in this case Frani told me that I have the opportunity to put poison in the bread dough in the bakery, since I enter freely and in this way we poison the communists and the cadres of the cooperative and the government…”!
In the conversation with the defendant Shtjefën Kurti, we talked: “… Shtjefni said why is this what we do in the cooperative, the good thing is that everyone has their own land, they can work freely and live as they want. Speaking about the cooperative, he said that later it will happen that everyone eats in canteens, lives together, not knowing his brother’s sister, that this is the system of these. You must work against this government as much as possible, the more you work against them, the closer is the day that this government will be overthrown. You, said Shtjefni, have good and loyal friends, you have Fran Ndoci and Bardhok Marku, work together against this government, work badly in the cooperative, make people unhappy, steal as much as you steal your sweat. If they steal, the income decreases and people become dissatisfied with the cooperative. For this you will have merit in the future”.
After that I met with Fran and Bardhok. They told me that Shtjefni had talked to them about the same things. In conversations with Fran Noci and Mark Bardhok in 1968 and onward, we talked about committing thefts and doing bad work everywhere in the cooperative, in order for the cooperative to have as little income as possible, to distribute to as few members as possible, these would become dissatisfied and rise up to destroy it…”.
The defendants Pjeter Biba and Zef Nishi explained to the investigator that in the meeting they had with Shtjefën Kurti, at his house, after we talked about the difficult situation in the cooperative, Shtjefni told them that “Since the cooperative is the cause of this situation evil, it must be destroyed, and in order to achieve its destruction, as many thefts as possible should be committed. By stealing, the income of the cooperative would decrease, the value of the working day would decrease, people would become dissatisfied and rise up in revolt for the destruction of the cooperative, they would not go to work, there would be quarrels and all this. will lead us to the destruction of the cooperative. According to Shtjefni, without doing this, people in this system will suffer. Shtjefni told them that by stealing they would not commit any sin, but they would only take their sweat and toil, they would take what was taken from them.
In order to continue the thefts in order to damage, weaken and destroy the agricultural cooperative, the defendants Pjeter and Zef also talked with the defendant Mark Marku, with the Gurezi mill.
Both of these defendants explain that at the dinner organized at Shtjefni’s house, where Mark Marku was also present, it was discussed to continue the thefts to the detriment of the cooperative in order to achieve the weakening and destruction of the agricultural cooperative. Shtjefni told them here too that this situation would bring dissatisfaction to the people and they would rise up to destroy the cooperative. To act in this way, all the defendants participating in this dinner have agreed.
In continuation of the hostile activity, the defendants Shtjefën Kurti, Mark (Bardhok) Marku, Pjetër Biba, Agustin Preçi, Fran Ndoci, Zef Nishi and Ndue Leti, from years until the day of their arrest, in meetings with each other and with witnesses, have developed hostile conversations against the government, which aimed at undermining and weakening the popular power. In terms of the economic situation of our country, by presenting this as difficult and at the same time they have praised the lifestyle of workers in Western and revisionist countries. Regarding the cooperative system, they made comments that: collectivization is harmful to the people, there is no income and it has impoverished the villagers. They have listened to and commented on the news of Western radio stations, especially Italian ones. They spoke against the leadership of the party and the state. They have been waiting for the change in the situation in our country, which, according to them, would be achieved by intervention from outside the imperialist-revisionist states, as happened in Czechoslovakia. They are opposed to the measures taken by the party and the government in the direction of further revolutionizing the life of the country, both in the direction of religion and in other directions. They talked about escaping to Italy as well as other talks against the party and popular power.
The defendant Shtjfön Kurti, as a furious enemy of the government, since he was released from prison, in the contacts he has had with the enemies of the government, the executed Zef Bici and Mark Dushi, has held hostile conversations with them against the popular government. In addition to the friendly talks, the defendant Shtjfën Kurti receives from Zef Bici books with content against communism, which he translates with the aim of making them known to others in order to oppose the politics of the party and the government. At the time Zef Bici was arrested, these translations, along with several other manuscripts with content against the government, were handed over to the defendant Mark (Bardhok) Marku to be burned, because he was afraid they would be caught by the Security authorities. .
Defendant Mark, as a loyal man of this furious enemy and the closest collaborator in this hostile activity, completes his order by burning them. Hostile conversations against the government, in addition to those held with the other defendants, the defendant Shtjefön also held with the defendant Catholic priest Anton Dohi and kulak Martin Rroku, both arrested for hostile activities against the government.
The defendants Mark (Bardhok) Marku, Agustin Preҁi, Pjetër Biba, Zef Nishi, Fran Noci and Ndue Leti, starting from 1960 and continuing, until the time of their arrest, in the meetings between them as well as with the witnesses, individually and by gathering three or four of them together, they hold talks against the government. Thus, in the meetings that the defendants Pjetër Biba and Zef Nishi had in the house of the defendant Shtjefön Kurti, they talked about the economic situation of our country, presenting this difficulty, for the agricultural cooperatives that they are not for the good of the people. they impoverished him, for overthrowing the government and other conversations of this nature. They have heard and commented on the news of foreign radio stations, especially Italian and Yugoslav ones.
The defendants Mark (Bardhok) Marku, Agustin Preҁi and Fran Noci, as furious enemies of the people’s power, talk among themselves to blow up the Stalin monument in Tirana, since the Party and the government in Albania followed the Stalinist policy, which, according to them, it was not for the good of the people. According to the defendants, this deeply friendly act was carried out with the aim of showing the enemies of the People’s Republic of Albania – the imperialists and revisionists, that there are elements in Albania that act against the people’s power.
Thus, in a meeting that the defendant Agustin Preҁi had with Fran Noci, he proposed to the latter to blow up the Stalin monument in Tirana and then escape abroad to Yugoslavia. The defendant Fran Noci, as an element with a pronounced hostile disposition, approves the opinion of the defendant Agustin, expressing to him that he was in complete agreement to carry out this act, but he was afraid of being dictated to and caught by the organs of the Security. The defendants, even being all three together, have talked several times to carry out such an act.
Regarding the above, the defendant Shtjefën Kurti explained to the investigator:
“… In the meetings I had with the defendants Mark Marku, Pjetër Biba, Zef Nishi, Agustin Preҁi, in individual meetings and all together, I told them that Albania has been liberated for twenty-six years and is still not being resolved from this power is bread, but the people kept calling bread, bread…! The peasant, who produces wheat, corn, milk, butter, etc., food items, does not have food for himself, because all these are taken from him by the state…! At the dinner at my house where Bardhoku, Pjetri and Zefi were also present, we talked about the possibilities of changing the situation in Albania, regardless of the commitment of R.P. of China for Albania, we said that the Soviet Union can immediately invade Albania, it is a powerful country, it has modern military means, while Albania does not have these. I told them that in Western countries people enjoy all democratic freedoms, because the political order there is different from the one in Albania.
Here we have a totalitarian state when people are not free to develop their political opinions, freedom of organization, speech and press…! When Agustin Preҁi asked me how God tolerates the communists who destroy the religion, I told him in the religious language that God sends the punishers and God punishes the punishers. With this, I told them that the punishers for us are the communists, but God will also punish these punishers of the West. I told them that this political system in Albania is bad today, but tomorrow we will be even worse…”! Memorie.al
