ON PROPOSALS FOR ARRESTS FOR CRIMINAL OFFENSES AGAINST THE STATE AND SOME DEFECTS OF THE WORK OF SECURITY AND INVESTIGATION BODIES
From the study of the proposals for arrests for criminal offenses against the state, made by the Branches of Internal Affairs in the Directorate of Investigation, during this 9 months, it appears that generally good work has been done to implement a fair policy in cracking down on hostile activity and malicious and legal requirements and platforms are better enforced.
There are also some important flaws and shortcomings which draw attention to a better job in the future.
- Status of arrest warrants.
The data show that the work for the prevention of crime is better organized, as well as the differentiation and rescue of people from hostile activity.
More proposals have been made by the Branches of Internal Affairs, Fier, Kukës, Saranda, Dibër and Tirana? They have been mainly for the criminal offense of agitation and propaganda against the state. Out of 66 proposals, 51 of them were for agitation and propaganda. There have been no proposals for sharp acts such as betrayal in the form of espionage, sabotage, etc.
Usually the espionage proceedings followed (a total of 8 cases), were hit with arrest for the criminal offense of agitation and propaganda against the state, since the act of espionage was not proven.
During the investigation, the aim was to prove the espionage accusation and it was achieved that the 5 defendants gave explanations for espionage activities. Of these defendants who have been identified as agents, four defendants as Yugoslav Intelligence agents, Nexhat Hamiti in Elbasan, Sulejman Aliu in Saranda, Hamdi Vata in Kukës and a Greek Intelligence agent, Havzi Dangëllia, in Korça. Nexhati and Ajet Iljazi are Kosovar emigrants with Yugoslav citizenship.
There are several issues under investigation that can be confirmed as espionage activities, such as: Vitali Paska and Jacques Jumba, in Tirana, with Congolese citizenship, as agents of American, Italian, Greek, Turkish and Yugoslav Intelligence. The two fugitives and returnees from Greece, Ilia Stavri and Stavro Kajavoj, as well as the Kosovar emigrant Ajet Iljazi.
- It is proposed to arrest objects of not sharp character and old age!
Some Branches of Internal Affairs, have not properly studied the objects received in processing and have not followed them carefully. In order to carry out their strike, proposals were made without analyzing the problems on all sides, especially for the character of the activity carried out, its breadth and the need to arrest the object in accordance with the conditions and circumstances of the district and the author himself.
This is how the Vlora Branch of Internal Affairs acted, for the Siri Jazo facility, born in 1900, for the data that for the past 10-15 years, who had once been convicted for agitation and propaganda against the state, for ten years imprisonment.
The Department of Internal Affairs proposes Xhemal Lile, for arrest for agitation and propaganda that he had agitated for the economic situation, allegedly bad in our country. He was born in 1918 and has been convicted twice for this offense and was released from prison a month ago.
The Saranda Branch of Internal Affairs has proposed Vasil Dhima, born in 1922, who had been processed for escape. This facility after being approved by the General Prosecutor, during the investigation became seriously ill was operated on and finally the case was dismissed, due to his health condition and old age.
It happened that the Branches of Internal Affairs, insisted on arrests of elderly people, such as Tropoja, for the Ali Hyka facility, as they thought to detect organized activities, but after the arrest, no measures were taken that were thought to follow the street agency and investigative.
- The Operational Sector and the Investigation do not study the materials objectively and propose to arrest objects with insufficient evidence
The agency-operational data and the minutes of the criminal report have not been analyzed objectively and comprehensively. The Directorate of Internal Affairs of Tirana has proposed for the tendency to escape the object, Agim Patoku, who had an implication from the defendant Vasil Plakushi and indirect evidence, from Alda B., that the sister of the object, Rita Patoku, told Alda, that: “My brother, Agimi, went to Miras in Korça, to see the border, to escape abroad”.
The Shkodra Branch of Internal Affairs has proposed Hysen Hyseni for an escape tendency, without having agency and operational data. There was only one reporting report, by Hamza L. heard with T.O. In these conditions, the proposal was returned with the duty that he should not be saved from the activity and the foreman should do the preventive work.
The analysis at the end of the facility does not become in-depth and the Investigation sector has not helped to the appropriate extent, for the objectivity of the evidence that is administered and the submission of proposals to the Ministry. It happened that the Investigator agreed to propose to hit the building, although the evidence was not complete, such as Korça, Saranda, Dibra, Tropoja, Lushnja, etc.
But there were also cases that the Investigation sectors did not agree to propose the arrest of the facility, as the evidence was not complete, as in Tepelena, Tirana, etc.
- Persons with bad personalities have been taken as accomplices.
The operational sector does not study in some cases the data it has received, linking them to the future of their trial and at the end of the processing; persons without personalities were asked as informants. In the process of the facility, Hysen Verdalis, the Branch of Internal Affairs in Pogradec, received a report from Sotir V., convicted of forgery of documents, who appeared several times as a witness, drunkard, etc., as well as Muharrem M. , convicted 3 times for beatings and sexual intercourse with violence. While in Lushnje, in the process of the Vangjel Bili facility, Agim M. was taken as a thief, convicted 8 times, who is ridiculed as a chicken thief in the village.
Mersin and Rexhep Hoxha from the Dibër Branch of Internal Affairs were proposed for the crime of preparing to flee abroad, but there was no information. The proposal was based on the statements of the informant Neim D., with whom they had talked about escape. In these conversations was also the sister of the whistleblower, who was their girlfriend and Naimi himself knew this fact.
- Counseling and unmasking of persons is being used more effectively and is valued by the public opinion.
Following the orders given by the Party, counseling and unmasking are being better evaluated in order to save those who can be saved from punishment. In the first 9 months of 1982, 11 people were advised and 8 were exposed, who had developed agitation and propaganda.
Well-organized consultations and unmasking have yielded positive results, in raising public opinion against hostile activity. It has worked well especially in the districts: Shkodra, Fier, Korca, etc. Bernard Lajthia, Pashko Marko and Bruno Hika were unmasked in front of the staff of the work center in Shkodra. The collective and co-workers rose up and condemned their act of wanting to flee abroad.
When it was necessary, the persons were oriented and advised or unmasked for the second or third time, when it was possible to save the person due to the non-sharp character of the crime, the good political situation, etc. This preventive form has been effectively implemented in Gramsh and Shkodra.
The above actions, contrary to certain rules and weaknesses, have occurred mainly due to insufficient work done during the agent processing phase and shallow analysis that was done before the arrest proposal. Agent materials and legal evidence, especially data from criminal records, have not been seen in unity.
Necessary attention has not been paid to legal evidence and flawed and unsubstantiated proposals have been made. These have been returned to the Branches of Internal Affairs with relevant remarks and tasks for the future to increase objectivity and strengthen legality in order to draw the right lessons and improve the work.
Continuing the work for the implementation of the tasks of the 8th Party Congress and the 4th and 6th plenums of the Central Committee of the Party, we are taking measures to improve the method of agency-operational work in processing. of facilities, because despite the improvements, there are still manifestations and concepts of activity that have been criticized and condemned to evaluate the work with the number of arrests not with rescued persons, fear of being criticized, etc.
The increase of the effect of the work for the discovery of the threads of the bourgeois-revisionist agency will be better studied. For the unification of work and the elimination of shortcomings from the operational and Investigative sector, we will prepare an instruction.
